Terms & Conditions

Living Divani INTERIOR & DESIGN (Pty) Ltd) TERMS AND CONDITIONS:

 The ownership of all equipment and interior items quoted and supplied through Living Divani Interiors & Design (PTY) Ltd remains the property of Living Divani Interiors & Design (PTY) Ltd until full and final settlement has been received.

  1. Payment for Design and other professional fees will be billed on a progress basis, and payment is due on issue of the invoice.
  2. Payment for the interior items relating to interior projects will be made as follows: 70 on acceptance of the order,25 % Progress Payment before arriving on site and 5% on completion of the project.
  3. Living Divani Interiors & Design (PTY) Ltd accepts no responsibility or liability for delays that are as a result of delays in payment of deposits from the client.
  4. Living Divani Interiors & Design (PTY) Ltd accepts no responsibility or liability for delays that are as a result of delays from other suppliers or contractors that have not been subcontracted under Living Divani Interiors & Design (PTY) Ltd.
  5. Living Divani Interiors & Design (PTY) Ltd accepts no responsibility or liability for delays that are as a result of incidents that occur which are out of the control of Living Divani Interiors & Design (PTY) Ltd, or for interior items selected by the client that carry extended lead-times.
  6. Prices of electronics and equipment are subject to final supplier quote, and are subject to change and exchange rate controls.
  7. Structural prices are subject to final subcontractor quotations and are subject to changes when/if designs change.
  8. All items indicated as an “allowance” in the budget or quotation should be treated as a “budget” price, and are subject to change based on final pricing to be received from subcontractors or suppliers.
  9. The client needs to grant Living Divani Interiors & Design (PTY) Ltd full access to the property throughout the duration of the appointed project.
  10. Living Divani Interiors & Design (PTY) Ltd will not be held responsible for any loss or Damage of the interior items once delivery has taken place.
  11. The interior items are to be insured by the client during delivery and installation, and any losses that arises as a result of theft, loss or damage of the interior items is not the responsibility of Living Divani Interiors & Design (PTY) Ltd.
  12. Living Divani Interiors & Design (PTY) Ltd will get approval for all of the customized interior items from the client and will not accept any returns of the interior items as a result of dislike, unless final product is not according to the proposed rendition signed off / written approval by the client.
  13. The client will not hold Living Divani Interiors & Design (PTY) Ltd responsible for any physical and financial loss or damage that result from the provision of the interior items and or any other service that Living Divani Interiors & Design (PTY) Ltd provides.
  14. Workmanship and product warranties on the Interior items will be passed on from suppliers to the client. This warranty does not stand if damage is a result of negligence or misuse. Living Divani Interiors & Design (PTY) Ltd reserves the right to access the interior items to determine whether the damage was result of poor workmanship or negligence and misuse. All warranties on equipment, electronic devices and appliances will be passed from suppliers and subcontractors onto the client, and must be dealt directly with the supplier.
  15. All deposits paid are taken as an acceptance and approval of the client budget or quotation and an instruction to proceed with the work as detailed in the approved client budget or quotation. Deposits paid are non-refundable. On acceptance of the final client budget or quotation and signature of this contract the client accepts liability for full payment of the amount as indicated on the approved client budget or quotation
  16. Lead time for installation and completion of project will be agreed upon with client directly as this vary based on the size of the project
  17. Complaints and snags should be addressed to Living Divani Interiors & Design (PTY) Ltd within 48 hours after completion of project. All complaints after 48 hours will be subject to a call out fee and repairs will be charged for.
  18. Living Divani Interiors & Design (PTY) Ltd reserves the right to investigate the complaint. All repairs unrelated to manufacturing and installation, will be charged for.
  19. All valuables should be removed prior to interior installation. Living Divani Interiors & Design (PTY) will not be held responsible for any loss or damage thereof
  20. Some wall paper has visible joints due to natural fibers etc. Living Divani Interiors & Design (PTY) will inform the client of this or offer the client alternative options
  21. In case of gas fireplace installations, the fireplace must be used at own risk. Living Divani Interiors & Design (PTY) will not be held responsible for any loss or damage caused by fire or gas
  22. Any small accessories such a buttons, trimmings, etc. is a choking hazard. Living Divani Interiors & Design (PTY) cannot be held responsible any results caused by choking.
